Online Terms And Conditions Of Sale

Any price stated by us (whether in store or online) is valid for 30 days only from the date provided and then will be subject to normal price rises. Special / Clearance prices only available when advertised and until desired stock level is cleared out.

Payment Terms- customer accept that any sale of products conditional on full payment of the product and delivery expense being received on the same day. You acknowledge by placing and order that the provisions of these Online Terms and Conditions of Sale apply to this contract between us.

Payment prior to Delivery – Orders are submitted on the basis of full payment of the quoted price and delivery costs being made on the purchased day.

Where the provisions of payment prior to delivery are not complied with, Royal Vanities have right to decide whether all amounts owing to s for any reason whatsoever shall become immediately due and payable without deduction or demand, or to rescind all discounted rates and recalculate the outstanding charges; and or cancel the order.

You agree to pay Royal Vanities all costs and legal expenses (on a full indemnity basis) whatsoever which Royal Vanities incur in relation to or arising from any breach by you of the terms of this Contract. Such costs and legal expenses (on a full indemnity basis) may be recovered from you by us as a liquidated debt.

Orders for items that are not stocked by Royal Vanities and which are ordered for the customer cannot be cancelled.

To the full extent possible any warranty implied into this Contract by law are expressly excluded. In addition any liability of Royal Vanities for any loss and damage howsoever arising (including any liability based on the negligence of us will be limited to the costs of the replacement of the goods and no other direct or indirect loss or damage including consequences losses are claimable by you against us. You will indemnify and forever keep us indemnified in respect of any claim arising out of or in connection to this contract.

Royal Vanities will not be liable whatsoever to you for any manufacturing or transport delays that you may endure.

You will deliver up to us at your sole expense, any item purchased by you that you believe to be defective or nonconforming in any way. If it is not reasonably practical to deliver the product to us for inspection, you will permit us to access any property for the purposes of inspecting the product.

You acknowledge that you know that some products may differ slightly from the dimensions or aesthetic appearance and that you are aware that these cannot be predicted or prevented and that this effect has no detrimental influence on the operation, durability or life of the product. You also accept that these differences are not a manufacturing fault and that neither the manufacturer nor Royal Vanities will accept liability for any such minor differences.

Title and Risk in the products only passes to you upon delivery.

We may at any time set-off amounts owed by us to you from the amounts owed by you to us.

Where there is a dispute between you and us which cannot be resolved to the mutual satisfaction of the parties, you agree to submit to the exclusive jurisdiction of the Courts of Victoria to hear and determine that dispute.

The provisions of the Goods and Services Tax legislation will apply to this contract.

That in accordance with the provisions of the Privacy Act, if Royal Vanities considers it relevant to assessing my/our application for commercial credit, I/we consent to Royal Vanities obtaining from a credit reporting agency a credit report containing personal credit information about me/us. In accordance with the provisions of the Privacy Act, if Royal Vanities considers it relevant to collecting overdue payments, I/we agree to Royal Vanities receiving from a credit reporting agency a credit report containing personal information about me/us in relation to overdue payments. Under the Privacy Act, if you have made a credit application to it, Royal Vanities is allowed to give a credit reporting agency personal information about, information which may be given to an agency includes, identity particulars, the fact that you have applied for credit and the amount, the fact that Royal Vanities is a credit provider to you, payments which become overdue by more than sixty (60) days and for which collection action has been commenced, advice that payments are no longer overdue, cheques drawn by you which have been dishonored more than once, that credit provided to you by ”Us” has been paid or otherwise discharged and in specific circumstances, that in the opinion of Royal Vanities, you have committed a serious credit infringement.

Payments and prices

When you place an order, we will charge you and you agree to pay the price and any applicable delivery fee.

All prices are in Australian Dollars and, if GST applies, inclusive of GST. Any fees and charges (including delivery fees) imposed by these terms also include GST where applicable.

Royal Vanities reserves the right to change or alter prices without notice to you. If you have already submitted an order at a particular price, we will supply your goods at that price (unless your order is affected by a pricing error.

Payment methods are specified on the Website or told to you at the time you place your order. They include credit card, PayPal etc.

Any payment for an order must be cleared by us before goods are dispatched. If your payment cannot be processed, your order will be rejected and you will be notified of this on the Website. If a credit card payment cannot be processed you should contact your card issuer to try to resolve the problem, or use an alternative payment method in order to continue with your order.

In paying or attempting to pay for goods, you agree that you have not engaged in any fraudulent conduct or contravened any Law.

Cancellations, exchage and returns

Unless provided for under these terms or as otherwise agreed by Royal Vanities, no cancellations or changes to orders will be accepted, and the goods will be delivered to the delivery address in an order. You should carefully check that your order is accurate before you submit it. You will, however, be able to return goods under the Returns Policy.

If we cannot contact you about your order using the contact details you provided in the order, after having made reasonable attempts to contact you, we will cancel your order and refund any money paid and any re-stocking fees would be deducted.

Delivery fees will not be refunded if you return goods for change of mind or you made an incorrect selection, including if you ordered the incorrect size, color etc.

Customer is liable for any return delivery cost involve for change of mind.

Goods can only be returned in accordance with these terms and the Returns Policy. The Returns Policy forms a part of these terms.

Royal Vanities will process any refunds within a reasonable time of agreeing to do so.

If the original payment was made on a credit card, refunds will be processed on the same card as the original payment was made.

For In-Store Orders, where you paid in cash or by EFTPOS, you can obtain a refund by returning to the store where you purchased the goods.

All goods must be collected within 14 days of order.

Restocking and/or repackaging charge of 20% will be applied for any returns due change of mind, incorrect sizes made after 7 days of purchase.

Restocking and/or repackaging charge of 10% will be applied for any exchange due change of mind, incorrect sizes made after 7 days of purchase.

Returned/exchange items must be uninstalled, undamaged, unopened, original packaging and in re-salable condition. Returns or change of mind will not be accepted after 30 days of purchase.

Customer is responsible for all returned shipping and insurance due to change of mind, incorrect sizes and accidentally ordered wrong product.

All items must be checked on pickup or delivery – no claims for missing or damaged items shall be recognized after 7 days of receiving of goods.

No exchanges or return on custom made, special orders, clearance items, floor stocks, ex-display or opened shower screen or mirror boxes.

We highly recommend to check all goods before installation. Any damages or faults found after installation will not be recognized after 7 days of receiving of goods.

Cancellations and returns – Packages

When items purchased as package, individual items will not be accepted as a returns or exchanges. The customer must inspect all the items prior to installing any of the items to ensure that there are no visible damages or faults.

In case of having to return or exchange package items the package deal will cancel and customer will need to purchase items for individual item prices including delivery. Standard 20% restocking and other return policies apply

Warranty and tanking care of products

All stone tops come with one year replacement warranty

Royal Vanities brand vanities come with 3 years warranty and warranty is limited to product replacement only.

Items from our partners (Aulic, ECT, Tribata, Oceano and convex are subject to manufacturers own warranty terms and conditions). All warranty claims must go through Royal Vanities and Our team will always help you to achieve the best outcome

Vanities are made of best materials such as solid timber, plywood, Moister resistant MDF and particle board and they are all moisture resistant. However, these materials can be affected by water if water sits on it for a long time and pernitrate through. Flooding, poor ventilation and incorrect installation can also lead water to leak in to cabinets and cause water damages. These water damages are not recognized as warranty claims.

All warranty claims need to be approved by a professional license builder. Builder’s licenses number must provide for any warranty claims after installation.

Delivery

Royal Vanities do free delivery only for specific items and design in specific suburb under Melbourne Metro (except Rye, Mornington Peninsula, Frankston, Mount Martha, Melton, Werribee- extra charges may apply. Please contact the office for for delivery charges)

Most of our Vanities are free delivery to advertised depots unless specified. We also do home deliveries in NSW, ACT, SA (please contact the office for delivery quote) and QLD but we do not deliver to NT, WA and Cairns.

Delivery quotes are strictly valid for 7 days unless specified

Termination

We may, at our discretion, terminate the agreement for the supply of goods to you. For convenience, at any time, on giving notice to you; or immediately if Royal Vanities reasonably believes that you have breached these terms and that the breach is not capable of remedy if you have been provided with notice of the breach, and you have failed to remedy that breach.

Promotions and discounts

The goods, prices, and promotions offered on the Website, eBay or catch of the day may not be the same as those offered in a Royal Vanities. Royal Vanities is not committed to match a price where the offer or price relates to an online only offer or where there is a price error.

Royal Vanities may email promotional material to you time to time which you could request to stop or remove your details from our promotional database

Personal Information, which you provide to us during the order including contact details, will be kept, used and disclosed by us in accordance with Royal Vanities Privacy Policy for the purpose of processing and delivering your order.

Risk & Liability

Risk and title in the goods passes to you on the date and time of delivery of the goods by the delivery agent or when collected in store.

Our goods come with warranties that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Royal Vanities excludes to the fullest extent possible under Law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these Terms.

You represent and warrant to Royal Vanities that Royal Vanities will not be liable for any expense or injury (including indirect loss such as loss of revenue, profits, anticipated savings, goodwill or business opportunity, injury to your reputation) in contract, tort, under statue or otherwise, howsoever caused including arising directly or indirectly from or in connection with these Terms.

Our liability to you for loss or damage of any kind arising out of these Terms will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

Updates and termination

Royal may vary these terms at any time. By continuing to use the sites you consent to any variations. It is your responsibility to regularly check these terms for any variations.
